Understanding Trademark Infringement
If you are going to register a trademark of your own, you first have to ensure that you are not infringing on a mark that someone else already owns. The following two cases are useful in understanding the elements of trademark infringement. Two Pesos, Inc. v. Taco Cabana. Inc., 505 U.S. 763 (1992); Wal-Mart Stores Inc. v. Samara Bros. Inc., 529 U.S. 205 (2000).
